With a TN Visa, you can live and work in the United States for extended periods of time. The TN classification permits you to work in the USA for up to 3 years initially and can be extended over and over without limit.<br \/><br \/><\/p><p>To qualify for a TN visa, you must work in the USA in one of the professions on the list of TN occupations (these professions are listed down below). You must also satisfy the educational standards and credentials required for the profession you will work in.<\/p><p>TN stands for Trade NAFTA. The TN visa is based on the North American Free Trade Agreement (NAFTA) Treaty.<\/p><p>With a TN visa, your spouse and children are eligible for TD status. With TD status your spouse and children cannot work but they can go to school.<\/p><ul><li><p>With a TN visa, you can initially stay in the USA for up to 3 years. There is also no limit to the number of times you can extend your TN status. So through the TN classification, you may be eligible to lawfully live and work in the USA for several years.<\/p><p>The TN visa classification does not require your US employer to get an approved Labor Certification. A Labor Certification certifies that the US employer was unable to find a suitable US worker to fill the position that they are hiring you for. To get a TN visa, your US employer does not need to get an approved Labor Certification. They can skip this process and just offer you a job.<\/p><p>Canadians are not required to get a TN Visa. Instead, they can apply for TN classification directly at a US Port of Entry (we will discuss this in more detail down below).<\/p><p>With a TN visa, your spouse and children may also be eligible for TD classification. With TD classification, they cannot work in the US but they can go to US schools.<\/p><\/li><\/ul><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"3\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-5863\" aria-expanded=\"false\">H1B- Bachelor's Degree or Higher Visa<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-5863\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"3\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-5863\" tabindex=\"0\" hidden=\"hidden\"><p>The H-1B visa is a work permit that allows foreign workers to go to the United States and work for American companies. The foreigner must specifically work in a field that requires specialised knowledge, for which the employer cannot find a US-based worker.<br \/><br \/>When applying for an H-1B visa, the applicant is sponsored by the American company that has hired them. The employer pays the visa fees and submits the required paperwork on behalf of the applicant.<br \/><br \/>The H-1B is a temporary (nonimmigrant) visa category that allows employers to petition for highly educated foreign professionals to work in \u201cspecialty occupations\u201d that require at least a bachelor&#8217;s degree or the equivalent.<br \/><br \/><\/p><div>\u00a0<\/div><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"4\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-5864\" aria-expanded=\"false\">H1B1- For citizens of Chile and Singapore<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-5864\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-5864\" tabindex=\"0\" hidden=\"hidden\"><p>The H1B1 category was created by the Free Trade Agreements signed with Chile and Singapore in 2003. The 6,800 available H1B1 visas each fiscal year can be an excellent alternative to the H1B visa for citizens of those countries. These visas are deducted from the 65,000 H1B visas that are available worldwide each year. The requirements for the H1B1 are largely identical to those of the H1B.<\/p><ul><li>here is no requirement that a petition first be filed with the USCIS. Chileans and Singaporeans may apply directly at a U.S. consulate for an H1B1 visa. A petition may be filed with the USCIS to change status to H1B1, or to extend H1B1 status.<\/li><li>H1B1 status is generally granted in one-year increments, and may be extended.<\/li><li>The H1B1 classification is available to some applicants who would not otherwise qualify for an H1B visa because they do not possess bachelors\u2019 degrees or the equivalent: Chilean citizens who are offered employment as agricultural managers or physical therapists, and Singaporean and Chilean citizens who are offered employment as disaster relief claims adjusters or management consultants.<\/li><li>As with the H1B visa, a\u00a0<strong>labor condition application<\/strong>\u00a0(LCA), certified by the U.S. Department of Labor, is required.<\/li><li>The spouse and minor children of an H1B1 employee are authorized to live in the United States in H-4 status, and to study, but are not permitted to work.<\/li><li>Unlike H1B and L visas, H1B1 visas are not considered\u00a0<strong>dual intent<\/strong>\u00a0visas. Therefore, a person in H1B1 status, who files for permanent residence (commonly referred to as a \u201cgreen card\u201d) may endanger his\/her continued H1B1 status.<\/li><\/ul><\/div>\n\t\t\t\t\t\t\t\t\t<div class=\"elementor-tab-title elementor-tab-mobile-title\" aria-selected=\"false\" data-tab=\"5\" role=\"tab\" tabindex=\"-1\" aria-controls=\"elementor-tab-content-5865\" aria-expanded=\"false\">E3- For Australian Citizens<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-5865\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"5\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-5865\" tabindex=\"0\" hidden=\"hidden\"><p>The E3 visa is a visa designed specifically for Australian citizens who will perform a \u201cspecialty occupation\u201d in the United States.<\/p><p>In order to obtain an E3 visa, you must:<\/p><ul><li>be a citizen of Australia or an Australian national,<\/li><li>have a job offer that requires a bachelor\u2019s level degree,<\/li><li>have a bachelor\u2019s degree or an equivalent level degree, and<\/li><li>the required professional license if the position requires a professional license.<\/li><\/ul><p>An E3 status visa is valid for up to 2 years and can be renewed indefinitely as needed. The dependent spouses and children of any and all E3 visa holders obtain E3D status. Understand that this visa is widely available as the annual numerical limitation on this visa, or the allowed number of annual visas of 10,500, has never been reached.<\/p><ul><li>here is no requirement that a petition first be filed with the USCIS. Chileans and Singaporeans may apply directly at a U.S. consulate for an H1B1 visa.
